Mediation and Arbitration

”Justice Delayed Is Justice Denied”

Front of United States Supreme Court

Or so the saying goes, but justice is also denied when a case is decided by people who know nothing about the subject matter.

Most people would not consider undertaking heart surgery with a person that had no medical training, never heard of blood pressure, arteries, or fibrillation and could not tell you the definition of an “iv”?

All too often, however, people undertake an arbitration or mediation with a person or persons that do not know the definition of PMA, never read an SSA, never heard of” PV” ,” PP”, or ” QCP” and are clueless when someone mentions “MSO,” or “Paragraph 3”.

For some reason, there are people that never flew a plane, were never trained in medicine and know nothing about the car business, that feel they are qualified to mediate or arbitrate those cases. And, the sad part is, the lawyers and clients accept them.

If you find yourself in that situation, you all can save a lot of money having the parties go into the hall and flip a coin to decide the case. The odds are 50/50 that you would get the same result.

Even if you do it right and get opposing lawyers and a judge or jury that are students of the industry, lawsuits can take from two to five years to come to trial, can cost hundreds of thousands of dollars, and can place untold stress and strain upon you and your business. So why not save yourself time, money and aggravation by getting an unbiased, educated opinion about your case, in a reasonable period of time, and for a reasonable fee?

Over the past three and one half decades, Mr. Pico has participated in over a thousand automotive transactions, representing both dealers and lenders in a plethora of dealership related transactions ranging from defending and pursuing lawsuits in the 1970s, to giving advice and suggestions with respect to buying and selling dealerships and negotiating out of trust transactions. Read this website for a more detailed background.

With over three and one-half decades of hands-on experience, Mr. Pico knows the business, which means two things to you: (1) you don’t have to pay to educate a judge about the car business; and (2) you get a decision / recommendation that is practical.

Mr. Pico has mediated such matters as dealer / lender disputes, divorces and partnership disputes and lawsuits.

You can spend an extraordinary amount of your money "trying to educate" someone about the intricacies of the automobile business, or for a reasonable fee, you can get an expert with credentials and experience in the field to give you an informed opinion regarding what is fair. The choice is yours.

An industry savvy mediator can make a difference in the rest of your life –– and so can a rookie.
